These Terms and Conditions apply to every use of the CoasterBingo mobile application, website pages that link to these Terms, and all related digital services that we make available unless separate terms expressly apply.
2. Acceptance of the Terms
By downloading, accessing, creating an account for, or using CoasterBingo, you agree to be bound by these Terms and Conditions. If you do not agree to them, you must not use CoasterBingo.
3. Eligibility and account registration
You must be at least 16 years old to create an account and use CoasterBingo. You must provide accurate, complete and current information and keep your login credentials confidential. You are responsible for all activity carried out through your account, except to the extent caused by our failure to take appropriate security measures.
You may not create an account under a false identity, impersonate another person, or otherwise mislead other users or us about your identity or authority.
4. Description of the service
CoasterBingo is a digital service for roller coaster enthusiasts. Depending on the features made available at a given time, CoasterBingo may allow you to maintain a personal coaster log, wishlist and achievements; compare progress with friends; manage a profile; receive in-app or push notifications; and access optional Premium functionality.
We may modify, improve, suspend or discontinue parts of the service where reasonably necessary for maintenance, security, legal compliance, product development, fraud prevention, or technical reasons. We do not guarantee that every feature will remain available indefinitely.
5. License and permitted use
Subject to these Terms and applicable platform rules, we grant you a limited, non-exclusive, non-transferable, revocable license to use CoasterBingo for your personal, non-commercial use on devices you own or control.
No intellectual property rights are transferred to you. All rights in and to CoasterBingo, including the app, software, database structure, branding, design, text, graphics and functionality, remain vested in us or our licensors, except for rights in your own lawful user content.
6. Premium subscriptions, billing and trials
CoasterBingo may offer free features and paid Premium features. The applicable price, billing interval, trial period, included functionality and renewal information are shown to you before purchase.
Purchases of Premium subscriptions on iOS are processed through Apple’s in-app purchase system. Apple is responsible for payment processing, billing interface, renewal mechanics, refund handling to the extent applicable under Apple’s policies and mandatory law, and subscription management inside your Apple account.
Unless cancelled in accordance with Apple’s subscription flow before the end of the then-current billing period or trial, your subscription may renew automatically for successive periods of the same duration. Deleting the app or deleting your CoasterBingo account does not by itself cancel an Apple subscription.
You remain responsible for reviewing the commercial terms shown at checkout. Any statutory consumer rights you may have under mandatory law remain unaffected.
7. Digital service performance and consumer rights
We aim to provide CoasterBingo with reasonable care and skill and in conformity with the agreement and applicable mandatory consumer law. If mandatory law gives you rights in relation to non-conforming digital content or digital services, nothing in these Terms limits those rights.
To the extent legally relevant, you acknowledge that CoasterBingo is a dynamic digital service that may receive updates, fixes, performance changes and feature adjustments over time.
8. User content and conduct
You may be able to submit or make available content or data within CoasterBingo, such as profile information, coaster history, ratings, wishlist entries, comments, social interactions or similar material ("User Content"). You retain ownership of your User Content, subject to the rights you grant below.
By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license for the term necessary to host, store, reproduce, adapt, display and otherwise process that User Content solely as needed to operate, secure, maintain, improve and provide CoasterBingo and to comply with legal obligations.
You represent and warrant that you are entitled to submit the User Content and that it does not infringe third-party rights, violate applicable law, contain malware, or include unlawful, fraudulent, threatening, hateful, discriminatory, defamatory, sexually explicit or otherwise inappropriate material.
9. Prohibited use
You must not, and must not attempt to:
- use CoasterBingo in violation of any applicable law or regulation;
- access or use another person’s account without authorization;
- interfere with, disrupt, overload, damage or compromise the security, integrity or availability of the service;
- reverse engineer, decompile, scrape, copy, frame or exploit the service except where mandatory law expressly permits it;
- upload malicious code, bots, scripts or automated requests that materially burden the service;
- manipulate achievements, rankings, friend features or other app mechanics through abuse or deception;
- harass, stalk, threaten or otherwise misuse the social functionality of the service.
10. Social features and visibility
CoasterBingo includes friend-based social functionality. According to the current product design, profiles and activity are not public and are intended to be visible only to users with whom you have a confirmed friendship connection. You remain responsible for the information you choose to add to your profile or activity.
We may introduce privacy controls, visibility settings or feature changes over time. Where material changes affect data visibility, we will update our Privacy Policy and, where appropriate, notify users.
11. App Store and third-party services
CoasterBingo may rely on third-party infrastructure and platforms, including Apple for distribution and in-app purchases, and backend or hosting providers for storage, authentication and service delivery. Third-party services may be subject to their own terms and privacy notices.
Apple and its subsidiaries are third-party beneficiaries of these Terms to the extent required by Apple’s platform rules, and may enforce these Terms against you in that capacity.
12. Updates, maintenance and security
We may deploy updates, bug fixes, patches and other changes that are reasonably necessary to keep CoasterBingo secure, functional, compatible and compliant. Some updates may be required for continued use of the service.
You are responsible for maintaining a compatible device, operating system and internet connection, and for installing updates made available through the App Store where relevant.
13. Suspension, restriction and termination
We may suspend, restrict or terminate your access to CoasterBingo, in whole or in part, with immediate effect where reasonably necessary if:
- you materially breach these Terms;
- we reasonably suspect fraud, abuse, unauthorized access or unlawful use;
- your use creates security, legal or operational risk for us, other users or third parties; or
- we are required to do so by law, court order, regulator, or platform provider.
Where appropriate and proportionate, we may first warn you and give you an opportunity to remedy the breach. You may stop using CoasterBingo at any time. If you request deletion of your account, your personal data will be handled in accordance with the Privacy Policy.
14. Intellectual property complaints
If you believe content within CoasterBingo infringes your intellectual property rights or other legal rights, contact us at support@coasterbingo.app with sufficient detail to identify the content, the right allegedly infringed and the basis of your claim.
15. Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for willful misconduct, gross negligence, death or personal injury where mandatory law so provides.
Subject to the foregoing and to the maximum extent permitted by law, we are not liable for indirect, incidental, consequential or punitive damages, or for loss of profits, goodwill, anticipated savings or business opportunity.
Subject to the same limitations, our aggregate liability arising out of or in connection with CoasterBingo, whether in contract, tort or otherwise, shall not exceed the greater of: (a) the total amount you paid to us for Premium during the twelve months preceding the event giving rise to the claim; or (b) EUR 50.
The limitations in this section apply only insofar as they are valid under the law applicable to you.
16. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless CoasterBingo from third-party claims, losses, liabilities, costs and expenses directly arising out of your unlawful use of the service, your User Content, or your breach of these Terms.
17. Privacy
Our processing of personal data is described in the Privacy Policy, which forms an integral part of the information provided to users of the service.
18. Changes to the Terms
We may amend these Terms where reasonably necessary, for example because of changes to the service, legal requirements, security needs or business operations. The most recent version will be made available through our website or within the app.
If a change materially affects your rights or obligations, we will take reasonable steps to bring that change to your attention before it takes effect, unless immediate changes are required for legal or security reasons.
19. Governing law and disputes
These Terms are governed by the laws of the Netherlands, except to the extent mandatory consumer protection law in your country of residence provides you with additional protection.
Any dispute not resolved amicably shall be submitted to the competent court in the Netherlands, without prejudice to any mandatory right you may have under applicable consumer law to bring proceedings before the courts of your place of residence.
20. Severability and interpretation
If any provision of these Terms is held invalid, unenforceable or unlawful, the remaining provisions shall remain in full force and effect. Any invalid provision shall be interpreted, or if necessary replaced, in a manner that most closely reflects its intended purpose to the extent permitted by law.
